We may report any participation in the Services by any Prohibited Users to the applicable governing state jurisdiction.

International Users

Our Websites are hosted in the United States and are intended for and directed to users in the United States. If you are a user accessing our Websites, Applications, or Services from anywhere outside the United States with laws or regulations governing personal data collection, use, and disclosure, that differ from United States laws, please be advised that through your continued use of our Websites, Applications, and Services, which are governed by United States laws, this Policy, and our “Terms and Conditions”, you are transferring your Personal Information to the United States and you consent to that transfer.

Children Online Privacy Protection Act

Our Services are not designed for children under 18 and we do not target our Services to children under 18. Only persons 18 years of age or older may use the Platform. If we discover that an individual under 18 has provided us with personal information, we will close the Account and delete such information. We encourage parents and guardians to take an active role in their children's online activities and interests.

We follow the rules and regulations of the Children’s Online Privacy Protection Act (COPPA) regarding collection of Personal Information.

California Online Privacy Protection Act

In Accordance with the California Online Privacy Protection Act (CalOPPA), we post a conspicuous Policy stating exactly the information being collected and how it is shared. Users can also visit our Websites anonymously. A California resident who established themselves as a user (“California User”) of our Websites, Applications, or Services and who has provided personal information is entitled to request information about whether we have disclosed personal information to any third parties for the third parties’ direct marketing purposes. Upon receipt of a request by a California User, we are required to provide a list of all third parties to whom personal information was disclosed in the preceding calendar year, and a listing of personal information disclosed.

However; under the law, we are not required to provide the above-described list if we adopt and disclose to the public this Policy of not disclosing customer’s personal information to third parties for their direct marketing purposes unless we give California Users a mechanism to opt out of having their personal information disclosed to third parties for their direct marketing purposes. Rather, we may comply with the law by notifying the California User of his or her right to prevent disclosure of Personal Information and providing a cost free means to exercise the right.

We have opted for this alternative approach. As stated in our Policy, we give customers a mechanism to opt out of having their Personal Information disclosed to third parties for their direct marketing purposes. Therefore, we are not required to maintain or disclose a list of third parties that received your Personal Information for marketing purposes. If you wish to opt-out of sharing your Personal Information with third parties for their direct marketing purposes, please reply to email communications with a stop request.

We employ appropriate security measures, which are reasonably designed to help protect your personal information from unauthorized access or disclosure. Linq3 Technologies may use encryption, passwords, and physical security measures to help protect your personal information against unauthorized access and disclosure. No security measures, however, are 100% failsafe. Therefore, we do not promise and cannot guarantee, and thus you should not expect, that your personal information or private communications will not be collected, disclosed and/or used by others. You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, keeping your log-in and password private, and not recycling passwords from other websites or accounts. Linq3 Technologies is not responsible for the unauthorized use of your information or for any lost, stolen, compromised passwords, or for any activity on your Account via unauthorized password activity.

We may retain information from closed Accounts to comply with the law, prevent fraud, collect any Fees owed, resolve disputes, troubleshoot problems, assist with any investigations of any user, enforce our Terms of Use, and/or for any other purposes otherwise permitted by law that we deem necessary in our sole discretion. You should understand, however, that once you transmit user content through the Platform, you may not be able to change or remove it. Once we have deleted or removed your Account, you agree that Linq3 Technologies will not be responsible to you for retaining information related to your Account.
